Divorce & separation disputes

Disputes of any nature can be stressful, unpleasant and emotionally draining, family disputes are usually all three and more, divorces and separations are typically messy and highly emotional situations to have to go through.

A new reform of the family court procedures in England and Wales came into effect on 6th April 2011, whereby all divorcing and separating couples will be referred to mediation to try and settle any disputes before being allowed to go to court.

Using mediation rather than going through court when divorcing or separating is much more favourable;

1.       Quicker, divorces can take years to finalise, a mediation can be arranged within weeks and conducted in a day or over a few sessions over a few weeks, opposed to several sessions over a longer period of time which is the typical family mediation model.

2.       Cheaper, whilst divorcing / separating parties argue over who paid for what, who should get what, their funds are being quickly eaten away, whereby there may be little if anything to divide once a settlement has been reached, once the legal and court fees have to be paid.

3.       Stressful, some degree of stress is inevitably going to be experienced, however the longer it takes to resolve the more stressful it shall be, mediation can reduce the burden of stress, rather than fighting it out through the legal process.

Family & extended family disputes

Families can get into dispute over almost anything; small minor misunderstandings, unforgiveable words / actions can escalate into lifetime feuds tearing families apart, which can in certain cases be carried on by the next generation. Family disputes can become severely problematic when family businesses are involved, or at the time of a bereavement.

Inheritance & probate disputes

Sadly at  the time of a bereavement disputes can surface concerning wills, their validity / legitimacy, allegations of fraud, inheritance, trusts, allegations of executors acting inappropriately, issues can be further complicated when somebody dies intestate (without making a will). As the typical dynamics of a family have changed over time this usually allows for others not directly linked to the family to bring claims also. At a time  when families should be mourning and pulling together they can be fighting over who gets what, jeopardising the value of the estate, which quite commonly has little if anything left in it, once the legal fees that have been racked up have been paid. Mediating inheritance and probate disputes not only can resolve such disputes  quickly, confidentially and successfully, but can also address family issues, and go someway to mending past fallouts.
