Med – Arb commences with a traditional mediation involving the assistance of a trained mediator. If an agreement is reached that is an end to the matter. If the parties cannot resolve the matter, (having agreed before the Med – Arb commenced), they can ask the mediator to change roles and to become the arbitrator. Either immediately at the close of the mediation, or at an agreed later date, the arbitrator takes evidence from the parties and renders a binding arbitration award (decision). |
