The claimant initiated proceedings after the landlord (local authority) allegedly unlawfully evicted her through a possession order and re let the property to another whilst she was out of the UK.
At mediation it was argued that the notice to quit was not lawfully served, as well as there being an alleged several months of rent arrears, the claimant stipulated she was deprived of her property which now was worth £46,000 more from the time of eviction.
Due to the claimant’s personal circumstances the defendant had to re – house her, with no admission as to liability, simply making a commercial decision they paid the claimants legal costs, agreed to re – house her offering a secure tenancy in an area of her choice and to pay removal and various disconnection charges.
